The Madras High Court has extended the deadline for the Tamil Nadu government to finalize its dog breeding policy to July 23. This policy aims to ensure ethical breeding, conserve native germplasm, prevent the introduction of foreign diseases, and implement a licensing regime for breeders.
Justice Anita Sumanth granted the extension after senior counsel R. Srinivas submitted amendments suggested by the Kennel Club of India (KCI) to the draft policy. Additional Government Pleader Vadivelu Deenadayalan confirmed the government's openness to considering these suggestions.
“Let the parties liaise with one another before the next hearing date to thoroughly discuss all items and decide what needs to be included. A finalized version of the dog breeding policy shall be presented to this court on the next date of hearing,” the judge ordered.
The KCI’s suggestions highlighted several issues. They noted that the draft rules require breeder license applicants from the Tamil Nadu Animal Welfare Board (TNAWB) to submit a license from the local authority and a no-objection certificate for the premises but do not specify the qualifications of the licensing authority.
“This task should not be entrusted to individuals who are not qualified to evaluate breeding stock or facilities required for breeding,” the council stated.
They also opposed the random neutering of male dogs and the spaying of female dogs if their offspring had genetic defects.
The KCI emphasized the importance of appropriate testing to determine whether a trait is genetic before making any decisions. They also noted that some breeds mature earlier than 18 months, opposing the draft policy's age requirement for breeding.
Additionally, the council argued against the prohibition of consecutive breeding seasons and the restriction on breeding dogs older than eight years, highlighting breed-specific reproductive cycles and longevity.
Finally, the KCI advocated for allowing tail docking and ear cropping for certain breeds, citing advancements in technology that make these procedures easier and painless.
