In a recent development, the Karnataka High Court has weighed in on the contentious issue of banning 23 "dangerous" dog breeds, including pit bulls, rottweilers, and mastiffs, stirring debates on responsible pet ownership. The court's verdict, delivered by Justice M. Nagaprasanna on April 10 and made public on Monday, underscored the imperative need for guidelines to fix accountability for pet owners.
Justice Nagaprasanna remarked, "It is not only those dogs which are branded ferocious that can indulge in inflicting harm upon the human beings or animals in the surrounding. Any dog can become ferocious." This pivotal observation sheds light on the complexity of the issue, emphasizing the importance of responsible ownership irrespective of breed.
The court's decision came in response to a petition filed against the Union circular by licensed dog handler King Solomon David and rottweiler owner Maradona Jones. Their argument, supported by evidence, challenged the efficacy of a blanket ban, asserting that Indian breeds like the Rajapalayam could inadvertently fall under the ban's purview.
Highlighting the lacuna in the consultation process, the court quashed the circular as contrary to the law, emphasizing the necessity of engaging stakeholders like the Kennel Club of India and People for the Ethical Treatment of Animals (PETA). This move aligns with recent developments in India, where the ban on the 23 dangerous breeds has been lifted, signaling a shift towards a more inclusive and consultative approach.
The court's directive underscores the global context, citing regulatory regimes in Denmark, France, Germany, and the USA. These comparisons elucidate that while restrictions exist, a blanket ban may not be the most effective solution. Instead, the focus should be on holding pet owners accountable for the safety of citizens and animals alike.
As the discourse on responsible pet ownership evolves, it is imperative for policymakers to heed the court's call for comprehensive guidelines. The welfare of both humans and animals hinges on striking a delicate balance between regulation and accountability in the realm of pet ownership.
