The Delhi High Court has intervened in the contentious issue of banning certain dog breeds deemed "ferocious" by directing the Centre to heed objections from various stakeholders before imposing any prohibition. This directive follows a series of pleas challenging a circular issued by the Ministry of Fisheries, Animal Husbandry, and Dairying on March 12, which sought to restrict the sale, breeding, and ownership of several dog breeds perceived as dangerous.
In a recent hearing, the High Court emphasized the importance of considering diverse perspectives before implementing such a significant policy. The bench, comprising Acting Chief Justice Manmohan and Justice Manmeet Pritam Singh Arora, underscored the necessity for public participation in the decision-making process.
"Other than government bodies, no private body was heard before the circular was issued," the court observed, highlighting the lack of inclusivity in the initial consultation process.
Responding to concerns raised during the hearing, the Center's counsel acknowledged the complexity of defining stakeholders in this context and expressed willingness to provide safeguards for affected parties. Meanwhile, petitioners criticized the March 12 circular as "perverse and illegal," citing its alleged violation of prior assurances to involve all stakeholders in the decision-making process.
This development comes in the wake of the Karnataka High Court's recent decision to overturn the circular, adding further momentum to the debate surrounding the regulation of "ferocious" dog breeds. The circular had proposed a ban on breeds such as Pitbull Terriers, Rottweilers, and Mastiffs, citing risks to human safety. However, the court's intervention underscores the need for a balanced approach that takes into account the concerns of both public safety and animal welfare.
The court's directive reflects a growing recognition of the importance of inclusive policymaking in sensitive matters like animal regulation. As the Center prepares to reconsider its stance on banning certain dog breeds, stakeholders eagerly await an opportunity to voice their objections and contribute to a more nuanced and equitable solution.
